General conditions

These general terms and conditions form an integral part of the rental contract between the lessee and the lessor NOMAD campervans. By signing the rental agreement, the lessee confirms that he has read these conditions and accepts them unconditionally.

1. Taking delivery of the vehicle

​

1.1 The lessee takes delivery of the vehicle in a clean and safe condition and with a full tank.  

1.2. Any accessories (navigation system, bike racks, camping accessories, etc.) are in perfect condition and are indicated separately in the rental agreement.  

1.3. Any complaints by the lessee regarding the vehicle and / or accessories must be immediately reported to the lessor upon collection of the vehicle.

2. Return of the vehicle

​

2.1. The vehicle and all accessories listed in the rental agreement must be returned in regular condition to the rental station and at the standard time. In case of delay, the lessee is obliged to pay compensation for any damages and will also be liable for the cases of coincidence. 

2.2. If the renter does not return the vehicle with a full tank, he must pay the costs for the fuel and refueling service (30 CHF) which are deducted from his deposit.

2.3. The car must be returned with a basic cleaning. It is not allowed to leave rubbish. The kitchen equipment must always be clean and the gray water emptied upon return. If the renter does not return the vehicle with a basic cleaning, he will have to pay a tax and cleaning fee and 150 CHF is deducted from his deposit.

2.4. Any loss or damage inside the vehicle or in the rented extras, equipment or spare parts, will be fully borne by the lessee.  

2.5. In case of non-compliant return of the vehicle and / or accessories, the renter is liable pursuant to art. 12 of these General Conditions . 

2.6. The return can only take place during the normal opening hours of the rental station to an employee of the lessor or a specific person authorized by the same. The simple parking of the vehicle at the rental station outside the opening hours and the deposit of the keys do not involve any refund.

3. Extension of the rental period

​

The extension of the rental relationship is only possible with the written consent of the lessor before the expiry of the current rental relationship. For this purpose, an additional deposit must be provided to cover the costs of extending the rental period. The landlord may refuse the extension without stating the reasons. If an extension of the rental agreement is agreed, all conditions of the original rental agreement continue to apply unchanged, unless otherwise agreed in writing .

4. Minimum age / license to drive

​

The minimum age of the lessee to rent and drive a vehicle of the lessor is 21 years. At the start of the rental, the driver of the rented vehicle must have had a valid driver's license for at least one year.  

 

5. Authorized drivers

​

The vehicle can only be driven by the lessee and the drivers indicated in the rental agreement with name and address. For additional drivers, the provisions of paragraph 4 apply equally. Even if he does not drive the vehicle, the lessee remains liable to the lessor for the fulfillment of the obligations arising from the rental agreement and the related additional conditions.

 

6. Rental fee

​

A standard rental starts at 17:00 and ends at 11:00, unless otherwise stated in the rental agreement. The exact delivery times can be agreed differently according to availability. If you wish to pick up the California before 5pm, you can also book a half day rental.  The rental price is established in the rental agreement and includes the use of the vehicle specified in the rental agreement for the agreed duration, as well as additional costs for accessories, if agreed. In case of delay of more than one hour, an additional rental day will be charged. In the event of early return, no refund will be made . 

 

7. Methods of payment

7.1. The 50% deposit must be paid one week after the booking to definitively reserve the car, otherwise the booking is canceled. The remaining 50% as well as the deposit of CHF 500, - must be paid in cash on delivery or in advance by bank transfer. Payment by bank transfer to Verena Helms, Via Üerts 20, 7512 Champfèr. 7.2. The lessor is authorized to invoice the lessee's debt arising from the rental agreement and relating thereto at a later time (costs for towing the vehicle, fuel, repairs, damages, penalties and fines, administrative costs). The final invoice is considered approved if the tenant does not contest it within 7 days by writing to NOMAD campervans, Via Üerts 20, 7512 Champfèr.

8. Cancellation conditions

​

Cancellation up to 90 days before the start of the rental period: CHF 0, -

Cancellation up to 60 days before the start of the rental period: 20% of the total amount

Cancellation up to 30 days before the start of the rental period: 50% of the total amount

Cancellation within 30 days before the start of the rental period: 100% of the total amount

 

9. Maintenance / repairs

​

9.1. The lessee is obliged to use the vehicle with utmost care and to regularly check the oil and water level and tire pressure (at least every 2000 km).  You must observe all traffic regulations and must carefully inform yourself about the traffic regulations of the countries where you are traveling with the vehicle.  

9.2. The lessee must immediately inform the lessor regarding defects that it is not his job to remove and follow his instructions in this regard. For costs relating to defects (engine oil, spare parts, repair costs), the landlord must first guarantee that the costs will be covered. Expenses incurred under this guarantee will be reimbursed to the lessee upon return of the vehicle, upon presentation of the relevant original receipts. Repairs carried out on the tenant's own initiative are prohibited. 

 

10. Behavior in case of accident and particular events

​

In the event of an accident, theft (burglary / embezzlement etc.), loss, fire, damage caused by game or other damage, the tenant is obliged to inform the police immediately and to have a report drawn up. This also applies in the event of accidents caused by one's own fault and without the involvement of third parties. Adverse rights will not be recognized. In the event of theft, loss or misappropriation of the vehicle, the police and the lessor must be contacted immediately. For all the above events, even in the case of minor damage, the lessee is obliged to immediately draw up a detailed written report to the lessor. In the event of an accident, the report must contain in particular the name and address of the persons involved and any witnesses, as well as the official number plates of the vehicles involved. In case of theft, the vehicle keys, the theft report and the police report must be presented to the landlord within 24 hours.

 

Disclaimer of Liability of the Lessor:

The lessor is not liable in the event that the rented camper vehicle fails due to an accident, technical defects, or other unforeseeable circumstances. This also includes events that occur during the rental period and are beyond the control of the lessor.

Efforts to Provide a Replacement Vehicle:

In the event of a failure of the rented vehicle, the lessor will make every effort to provide a comparable replacement vehicle. However, the lessor is under no obligation to procure such a replacement vehicle. If the lessor is unable to provide a replacement vehicle, this does not give rise to any claims for damages or other demands on the part of the renter.

No Liability for Replacement Procurement:

If the lessor, despite all efforts, is unable to provide a comparable replacement vehicle, they cannot be held accountable for this. In this case, the renter is not entitled to compensation, reimbursement, or other services beyond the rental fee already paid.

Refund in Case of Failure:

If the rented vehicle fails due to an accident or another unforeseeable event and no replacement vehicle can be provided, the lessor will refund the renter the rental fee for the rental period. Further claims against the lessor are excluded.

11.1. prohibition to use the vehicle for:

  • to participate in sporting events, testing and driving school

  • for the transport of goods or persons for a fee

  • for towing or moving another vehicle

  • with overload, i.e. with a number of people or payload higher than the data shown on the vehicle license

  • for the transport of flammable, explosive, poisonous or otherwise dangerous materials

  • to commit customs offenses or other offenses, even if punishable only according to the law of the place of the offense

  • sub-rental

11.2. The use of the vehicle is permitted in the following countries:

Austria, Belgium, Croatia, Denmark, Finland, France, Germany, Great Britain, Ireland, Italy, Luxembourg, Norway, Netherlands, Portugal, Czech Republic, Slovakia, Slovenia, Spain, Sweden, Switzerland, Hungary. This also applies to the use of the vehicle on the islands belonging to these countries (with the exception of the Azores, the Canary Islands, Madeira and overseas territories). The use of the vehicle abroad is only permitted with the prior written consent of the lessor. The use of the vehicle in all other countries constitutes a substantial breach of contract and results in the termination of all limitations of liability.

12. Liability of the lessee

​

12.1. The lessee is liable for all damages (in particular damage to tires and glass) caused by the lessee or his assistants who act improperly or in violation of the law or the contract . 

12.2. The lessee is liable for all damages (in particular for damage to tires and windows) regardless of whether they are his responsibility.  

12.3. The lessee is responsible in particular for all defects and damage to the vehicle for which he is responsible. This includes, but is not limited to, damage caused by: refueling with incorrect fuel, failure to comply with the maximum height (at the entrance to garages, in underpasses and the like); improper use of snow chains, ski racks, incorrect loading of ski racks, careless use of the interior (in particular cigarette burns, tears and stains on upholstery and mats), off-road driving and in general careless use (in particular damage to the underbody, steering, gearbox, springs and shock absorbers, and damage to axle parts, cross members, oil pan, cables, exhaust system, shield deflectors and shifters), incorrect handling of the vehicle (mechanical damage to the clutch, gearbox, suspensions, etc. not covered by the warranty by the workshops referred to in the contract), incorrect use of the roof (in particular, failure to close or incorrectly close the roof.) _ cc781905-5cde-3194-bb3b-136bad5cf58d_

12.4. The scope of liability includes repair costs and the value of the vehicle in the event of total loss, as well as further damages such as towing costs, appraisal costs, impairment, non-rental, legal and administrative expenses. 5cde-3194-bb3b-136bad5cf58d_

12.5. In the event of fines or penalties in connection with the use of the vehicle for which the lessor is responsible, the lessee is obliged to reimburse the corresponding amount plus the administrative costs of the lessor. Sanctions and fines due to the fault of the landlord are excluded. In the event of a violation of the road traffic law in Switzerland and abroad, the lessee authorizes the lessor to pass on the contractual data to all authorities (police, lawyers, road traffic offices, etc.) in Switzerland and abroad.  

12.6. the lessee's liability is reduced to the amount of the deductible established in the rental agreement per event. This disclaimer does not apply to the damage described in paragraph (12.3.) In the case in question, there is no coverage for the damage caused to the lessor. The liability exemption does not apply to damage resulting from use by an unauthorized driver or for damage due to prohibited uses, in the event of road piracy by the lessee, for damage caused with intent or negligence to pursuant to the Highway Code, in particular in the event of exhaustion, inability to drive due to alcohol or drug abuse, as well as for damage attributable to inappropriate load.

12.7. Any exemption from liability of the lessee by the lessor is valid only if it takes place in writing.

13. Liability of the lessor

​

The lessor is liable for damages of the lessee resulting from defects in the vehicle on the basis of the prerequisites of Articles 259a and 259e CO, provided that liability is not otherwise regulated by personal agreement. Any contractual and non-contractual liability of the lessor towards the lessee and any other persons authorized by contract is excluded, provided that the lessor did not cause the damage intentionally or through gross negligence. The landlord is not liable for damage caused by his auxiliary persons.

​

Animals can only be transported on request. All vehicles are also strictly non-smoking. In the event of a violation, a fee of CHF 400 is levied. The additional costs for special cleaning are to be borne by the dealer.

15. Home equipment

​

Kitchen utensils such as pots, crockery and cutlery are included in the daily rental price.

​

16. Fee for making motor vehicles available

​

The cost for collection of the vehicle is 150 CHF per rental which includes instructions (video), camping equipment, a gas bottle, parking space for the renter's car at the pick-up station, external cleaning of the vehicle.

17. fully comprehensive and civil liability insurance

​

Our rental vehicles are insured with civil liability and comprehensive insurance in the amount of CHF 100 million . 

The deductible per claim amounts to:

- civil liability CHF 1000, -

This includes damage caused by fire, collision, vehicle theft, natural hazards, slipping snow, collision with animals, damage to glass. The insurance does not cover damage caused by gross negligence, damage due to non-compliance with the height of the vehicle, driving under the influence of alcohol or drugs or violation of the rental conditions. Damages and expenses resulting from incorrect refueling and / or incorrect refilling of liquids in the containers are the responsibility of the tenant. Vehicle insurance rejects any benefits. Damage to the interior of the vehicle, awning, tables, camping chairs and bicycle rack is not covered, unless it is due to an accident. The tenant must always bear the surplus.

18. additional kilometers

​

The rental price includes 200 kilometers per day. In the event of additional km, a supplement is charged for each additional kilometer (CHF 0.70 km) when the vehicle is returned. Alternatively, a kilometer package can be purchased at the start of the rental at a cost of CHF 25, - / day for an additional 100 km / day or CHF 35, - / day for unlimited km. unlimited km from 21 days.

19. taxes

​

All taxes are already included in the rental price.

​

20. Right of retention

​

Any right of retention of the vehicle by the lessee for alleged claims against Califorent is excluded.

​

21. Changes to the contract

​

To be valid, additions and changes to this contract require written form.

​

22. Applicable law and competent court

​

This contract is governed by Swiss law. Place of jurisdiction is Chur.
